How Long Will it Take to Resolve My Case?

Depending on court congestion and other factors that many differ in various California counties, most cases can be resolved within two to three years. For cases involving minors under age 14, Dr. Fagel uses the provisions of CCP Sec. 36 (g) to obtain an early priority trial date within nine months of the filing of a motion. Dr. Fagel was involved in the legislation of this statute and brought the first case that confirmed this statute as mandatory on courts. Since then, he has effectively utilized this rule to resolve most of the cases involving children injured at birth and has obtained settlements within 18 months of filing such claims. However, in cases that do not have a statutory priority, Dr. Fagel aggressively pursues these claims within the limitations of each county and usually obtains a settlement within 24 months of filing.
